Heidi Montag has decided to make her recent separation from husband Spencer Pratt legal.
The Hills star filed for legal separation from Pratt on Tuesday morning at the Santa Monica Courthouse, citing irreconcilable differences, TMZ reported.
Since Montag did not file divorce papers, she and Pratt remain married. However her earnings will now become separate property as of Tuesday, according to TMZ, which added under the filing’s “community assets and debts” section Montag wrote, “No such assets or debts.”
“As far as she’s concerned the marriage is over,” a source told RadarOnline, which also reported the filing.
“She’s not quiet ready to file for divorce. She had great concern for her finances; Spencer has been spending what she considers to be her money.”
Montag — who wed Pratt in April 2009 — moved out of the Pacific Palisades, CA home she shared with him late last month, but didn’t make any legal filings. Instead, she stated the couple is “working on things” and she “just needed some space.”
Multiple sources have recently claimed that Montag and Pratt’s split is a publicity stunt because The Hills is currently in the midst of airing its final season and the couple has no new projects on the horizon.
The Hills co-stars Audrina Patridge and Lauren “Lo” Bosworth and The City star Whitney Port also recently stated they doubt Montag and Pratt’s split is for real.
Montag initially tried filing for separation in Malibu, however that city’s court does not handle divorces — causing her to go to Santa Monica, TMZ reported.

Continuing to chat with press about her relationship woes, Heidi Montag most recently spoke about her need for “time apart” from Spencer Pratt.
Talking to People magazine, the “Hills” reality star explained, “I needed some alone time. There are so many lies out there about me and I just needed space – even away from my husband.”
The 23-year-old continued to say that there wasn’t a big incident leading to her move-out – more an accumulation of issues.
“I had to get away from the lies my family and supposed friends are saying about me,” Montag tells. “It’s time to concentrate on myself.”
Not giving up hope on getting back with Pratt in the future, Montag finished by saying, “I’ve always loved Spencer, but right now we’re working on things.”

Heidi’s rep tells TMZ, “Heidi is looking to move out due to all the fake bad press that Spencer controls. She’s tired of it and is looking for a place and wants to focus on her acting career.”

As TMZ first reported, Heidi and Spencer called the police on Heidi’s mom a few weeks back … so there’s been plenty of turmoil.

Now it makes sense … On Tuesday, Heidi tweeted, “I am not Heidi Pratt, I am Heidi Montag.”

As gun-loving Spencer Pratt grows more unstable and erratic, family and friends worry that Heidi Montag needs to be saved!
In our May 31 issue, the reality TV starlet’s own father tells Star exclusively that he’s concerned about Heidi’s well-being as stories swirl of her nightmare life with Spencer — complete with guns in their home, windows covered to block out daylight, dirty dishes stacked up in the kitchen and unhousebroken puppies relieving themselves all over the floor.
“I’m worried for her,” Bill Montag — who hasn’t heard from Heidi since March — reveals to Star exclusively. “I’m afraid for her life.”
And he isn’t willing to take a wait-and-see approach to the situation.
“If I don’t hear from them soon, good or bad, I will take my family and get his family and go there and talk to them,” Bill says. “They can call the police on me too. I want to make sure both of them are OK.”

Another day, another drama for Heidi Montag.
On Thursday, the Hills star called police after her mother, Darlene Egelhoff, arrived at her Los Angeles home.
“My mom showed up unannounced to my house when she knows I have no interest in seeing or talking with her,” Montag, 23, tells PEOPLE. “She tore my heart out on national television. She is just trying to create drama in my life.”
Montag and her mom have let the drama unfold on camera too. Earlier this season on the Hills, Montag returned home to Colorado to show off her new body after undergoing 10 plastic surgeries in one day. Her mom’s reaction drove the reality star to tears and prompted her husband, Spencer Pratt, to declare on Tuesday’s episode, that Egelhoff “decided to rape my wife emotionally.”
Los Angeles police confirm that Egelhoff came to her daughter’s house on Thursday and was turned away.
“Officers arrived on the scene and advised the mother that since her daughter’s an adult, she doesn’t have to speak to [the mom] if she doesn’t want to,” Los Angeles Police Department Sgt. Leffew tells PEOPLE. “The mother said ‘fine, no problem’ and left. There were no citations or arrests.”
And Montag says this isn’t the end of all the drama. “I made it very clear that I want nothing to do with her in my life right now,” she tells PEOPLE.
Continues Montag: “I’m sick to my stomach she would even do something like this. She needs to stay away from me. I’m planning on getting a restraining order against her.”
Heidi’s mom is such an attention whore! Shes being a horrible mother by ripping Heidi to shreds on television and just needs to stop. It’s really not cute!

Heidi and Spencer Pratt, featured prominently on MTV’s hit show The Hills since 2006, might not appear on the series’ last episode, reports the new Us Weekly (on newsstands now).
Neither has taped since mid-April (Us Weekly previously reported that Spencer, 26, was suspended from the show after threatening to kill a producer; Heidi’s role was reduced after she objected to a faux-divorce story line).
A source tells Us Weekly show creator Adam DiVello “said he doesn’t think Heidi and Spencer will come back for the series finale.”
Heidi, 23, wasn’t invited to a secret May 6 powwow Divello had with the female cast in Santa Monica, Calif., to brainstorm the series finale.
“All the girls were asked to come up with ideas of how the show can end,” an insider tells Us Weekly. Among the ideas: a trip to Costa Rica for the 100th episode (two before the finale) and a future Sex and the City–style movie sequel.
“He wants The Hills to end on an upbeat tone,” a source tells Us Weekly of DiVello’s plan. “He wants to show the audience that the girls are going on to bigger and better things and that the show was good for them.”
